Welcome to Zia Homeworx (“we”, “us”, “our”). By accessing our website or engaging our services, you (“you”, “the client”, “the user”) agree to the following Terms & Conditions. Please read them carefully. If you do not agree with these terms, please discontinue use of our website and services.

1. Overview

These Terms & Conditions (“T&C”) govern:

  • Your use of the Zia Homeworx website

  • Any inquiries, consultations, quotes, proposals, or services you receive

  • The legal relationship between you and Zia Homeworx
     

We reserve the right to update or modify these terms at any time. Continued use of our site or services constitutes acceptance of the latest version.

2. Scope of Services

Zia Homeworx provides home improvement and personalization services including, but not limited to:

  • Custom accent walls

  • LED lighting installation

  • Garage cleaning & organization

  • Pet-friendly installations (cat walls, catios, etc.)

  • Small handyman tasks and functional home upgrades

  • Residential maintenance work
     

All services are performed based on the written estimate or proposal provided to the client.

3. Estimates & Additional Charges

All quotes are estimates based on visible and disclosed conditions at the time of inspection.  You acknowledge that:

  • Hidden issues (e.g., electrical obstructions, water damage, unlevel or out of square walls, poor paint adhesion, structural defects) may affect final pricing. (issues will be communicated and work halted until issue is acknowledged by customer.) 

  • Additional work requested after the job begins will be billed separately.

  • Any necessary changes or additions must be approved in writing (text/email acceptable).
     

We reserve the right to adjust pricing accordingly.

4. Client Responsibilities

To ensure safety and efficiency, the client agrees to:

  • Provide clear and safe access to the work area

  • Secure pets and children away from the workspace

  • Remove personal belongings unless paid organizing services include this step

  • Disclose any known structural, electrical, or water-related issues
     

Zia Homeworx is not responsible for damage to personal items left in the work area.

5. Materials & Product Responsibility

Zia Homeworx may provide or install materials purchased by the client.  You agree that:

  • Zia Homeworx is not responsible for defects in client-provided materials

  • Returns, replacements, or malfunctions of such materials are the client’s responsibility

  • Custom materials or special orders may require payment upfront
     

If a product supplied by us is defective upon arrival, we will handle the replacement through the supplier.

6. Payment Terms

Payment structure:

  • A deposit may be required to schedule work (typically 25–50% depending on project scope).

  • Final payment is due immediately upon project completion.

  • Late payments may incur a fee of up to 10% per month.
     

Accepted payments: cash, credit/debit card, bank transfer, or other approved methods.  We reserve the right to pause or discontinue work if payments are not made as agreed.

7. Cancellations & Rescheduling

To protect our scheduling and time:

  • Cancellations made less than 48 hours before the scheduled start may result in forfeiture of deposit.

  • Rescheduling is allowed once without penalty if notice is provided at least 48 hours in advance.

  • Sudden on-site cancellations may be billed for time and travel.
     

We reserve the right to reschedule due to safety issues, weather conditions, or unforeseen circumstances.

8. Workmanship Warranty

Zia Homeworx offers a limited 30-day workmanship warranty on completed work.

This warranty does not cover:

  • Damage caused by misuse, moisture, leaks, pets, or structural shifting

  • Issues resulting from pre-existing conditions

  • Materials supplied by the client
     

LED lighting warranties are subject to the manufacturer’s policy.

9. Liability Limitations

To the fullest extent permitted by New Mexico law:

  • Zia Homeworx is not liable for incidental, indirect, or consequential damages

  • Liability is limited to the cost of the service rendered

  • We are not responsible for hidden defects, prior contractor mistakes, or pre-existing structural issues
     

All services are performed “as-is” based on the condition of the home.

10. Website Use & Intellectual Property

All content on this website—including text, images, logos, and media, is property of Zia Homeworx.

You may not:

  • copy

  • distribute

  • republish

  • modify

any part of our site without written permission.

11. Photo and Video Permission

Unless otherwise stated in writing:

  • You grant Zia Homeworx permission to take before/after photos of completed work

  • We may use such media for marketing, portfolio, and social media purposes

  • No personal information or identifying details will be shared
     

You may opt out by requesting this in writing before the project begins.

12. Governing Law

These Terms & Conditions are governed by the laws of the State of New Mexico.
Any disputes will be handled through negotiation first, then arbitration if necessary.
